Balance Quest

Terms of Use

Effective date: October 26, 2026 · Last updated: October 26, 2026

These terms are an agreement between you and Juan Ortega, an individual developer based in Langley, British Columbia, Canada ("we", "us") for using the Balance Quest app on phones, tablets and watches. By using the app you agree to them. Our Privacy Policy explains how we handle your data.

1. A wellness app, not medical care

Balance Quest helps you practice balance exercises and follow your progress against your own baseline. It is not a medical device. It does not diagnose, treat, cure, monitor or prevent any disease, and it does not predict falls. It does not replace advice from a doctor, physiotherapist or other professional.

Balance exercises carry a risk of falling. Practice next to a counter or sturdy support, on a clear floor, and stop if you feel dizzy, unwell or in pain. Talk to a professional before you start if you fall often, feel dizzy day to day, are recovering from surgery or injury, or have a condition that affects your balance. You practice at your own risk, to the extent the law allows.

2. Who can use the app

You must be at least 16 years old, or older if the law where you live requires it, and able to enter a contract. You're responsible for keeping your Apple or Google sign-in secure.

3. Subscriptions and free trials

4. Using the app fairly

You agree not to:

We may suspend or close an account that seriously or repeatedly breaks these rules.

5. Your content

You own what you add to the app, such as a therapist's plan or voice notes. You give us permission to store, process and show it only as needed to run the app for you and the people you choose to share it with.

6. Our app

The app, its character, artwork and software belong to us or our licensors. We give you a personal, non-transferable licence to use the app on devices you own or control, under these terms and the store's rules. If you downloaded the app from the App Store, Apple's Licensed Application End User License Agreement governs your licence, and these terms add to it; if the two conflict, Apple's agreement wins for the licence. Apple is not responsible for the app or its support.

7. Changes to the app and these terms

We keep improving the app and may change or remove features. If we change these terms in a way that matters, we'll tell you in the app before the change takes effect. If you don't agree, you can stop using the app and cancel your subscription.

8. Liability

We provide the app with reasonable care and skill, but we can't promise it will always be available or free of errors. To the extent the law allows, we are not liable for indirect or unforeseeable losses, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that can't be limited by law, and nothing affects your statutory rights as a consumer.

9. Ending the agreement

You can stop using the app and delete your account at any time; see how to delete your account. These terms end when your account is deleted, except the parts that by their nature should continue.

10. Governing law and disputes

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts. Please contact us first so we can try to fix the problem.
